Alert immigrants who have belonged to a totalitarian party in their respective countries or abroad.

Immigrants who belong or have belonged to a totalitarian political party such as the Communist Party or its derivatives, the U.S. Citizenship and Immigration Services (USCIS) will apply its policy of inadmissibility, that is, of not being admitted or accepted on U.S. soil for reasons of membership in a totalitarian party.

Recently the U.S. Citizenship and Immigration Services – USCIS, issued a policy guide in the Policy Manual to address inadmissibility on the grounds of membership or affiliation with the Communist Party or any other totalitarian party. Membership or affiliation with the Communist Party or any other totalitarian party is inconsistent and incompatible with the Pledge of Allegiance to the United States, which includes swearing to “support and defend the Constitution and laws of the United States.

The new section of the policy manual provides guidance on how to adjudicate inadmissibility based on membership in the Communist Party or any other totalitarian party in the context of applications for adjustment of status. 

Generally, unless otherwise exempt, any prospective immigrant who is or has been a member or affiliate of the Communist Party or any other totalitarian party (subdivision or affiliate), national or foreign, is inadmissible to the United States. This addition to the policy manual will assist officials in adjudicating these grounds of inadmissibility in a manner consistent with applicable law.
