Adjustment of status vs consular process: which is right for you

When a family or employment petition is approved, there are two paths to the green card: adjustment of status (I-485) within the United States, or leaving and processing at a consulate (DS-260). The right choice can save you money, time, and in some cases avoid 3/10-year bars. This guide compares both routes.
What is adjustment of status?
The process of becoming a permanent resident without leaving the U.S. Filed via:
- Form I-485 (Application to Register Permanent Residence).
- Form I-693 (medical exam).
- Form I-765 (EAD) and I-131 (Advance Parole) optional.

What is consular processing?
The process at a U.S. consulate abroad. You file:
- Form DS-260 online.
- Medical exam with authorized doctor.
- Certified civil documents (birth, marriage, background).
- Interview at the consulate.
Upon approval, you receive an immigrant visa and enter as a resident.
Who can use adjustment (I-485)
To adjust you must:
- Be physically in the U.S.
- Have an approved or pending petition (I-130, I-140, etc.).
- Have a visa number available (no visa bulletin backlog).
- Have entered legally —generally. Exceptions:
- INA 245(i): if had a petition or labor cert filed before April 30, 2001.
- VAWA self-petitioner.
- Immediate relative (spouse, parent, child under 21 of citizen) who entered legally even if overstayed.
- Not be inadmissible (or have a waiver).

When adjustment is the better choice
I-485 suits you if:
- You have legal status and entered with a visa.
- Immediate relative with valid I-94.
- 245(i) qualified.
- No unlawful presence over 180 days.
- You want to work while waiting.
- You care about not separating from family.
When consular processing is the better choice
Consular suits you if:
- You are outside the U.S.
- You entered without inspection (EWI) and don't qualify for 245(i).
- Your case is employment-based from abroad.
- You want to finish faster (in some cases).
The 3/10-year bar problem
If you had unlawful presence of more than 180 days or more than one year and leave, a bar is triggered:
- 3 years if 180-365 days.
- 10 years if more than a year.
That's why many can't go to the consulate without a waiver. The solution is:
- I-601A (Provisional Waiver): approved before leaving, based on extreme hardship to citizen/resident spouse or parent.
- Only covers unlawful presence; other inadmissibilities need I-601.

What if I'm denied?
- I-485 denied: you may appeal or re-file; you may end up in removal proceedings.
- Consular denied: you are stuck outside the U.S. with very few options to return.
That's why consular is riskier if there are weak points.
Special cases
- Spouse of citizen inside the U.S.: almost always I-485 if entered with a visa.
- H-1B employee: I-485 when visa is available.
- Diversity visa lottery: depends on where you are when you win.
- VAWA: almost always I-485 even if entered without inspection.
- Approved asylum: adjust with I-485 after 1 year.
