Civil fines and fraud: when they affect your immigration case

Many people assume that any fine or civil penalty automatically ruins an immigration case. The reality is more nuanced. Some fines are irrelevant; others can be fatal. This guide explains what USCIS looks at, which types of penalties actually matter, and when a waiver is available.

The basics: USCIS evaluates "good moral character"

Almost every major application —green card, naturalization, adjustment of status— requires showing good moral character. A parking ticket does not destroy that. But a pattern of financial fraud does.

Minor traffic tickets

Speeding, red light, or parking tickets generally do not affect your case as long as:

• They were not DUI (driving under the influence).
• You paid them.
• There's no excessive pattern (dozens of unpaid tickets).

However, on Form N-400 (citizenship) you must list every citation even if dismissed. Lying or omitting is far worse than the ticket itself.

DUI (Driving Under Influence)

The picture changes here:

• A DUI is not automatically inadmissible, but USCIS treats it as a serious negative factor.
• Two or more DUIs in five years can result in denial of good moral character.
• If there was an accident with injuries, the case can become an aggravated felony.
