Can a person leave the United States while in asylum proceedings? The answer is Yes! However, keep in mind these 4 points…‌

  1. You cannot be in judicial removal proceedings.
  2. You cannot use it to go to your country of origin or where you are a citizen.
  3. You must not have a criminal or civil judgment against you or an unfavorable criminal record.
  4. It is advisable to be used only for emergency situations.

Unlike TPS Parole which allows you to:

  1. travel outside the U.S., even to your home country (as long as you are not seeking asylum);
  2. You do not need to justify your TPS parole application with an emergency.
  3. If you have a criminal record or pending lawsuits against you, it is recommended that you seek legal counsel before using the TPS travel permit.‌
