When a resident can apply for citizenship: time requirements

One of the first questions we get from permanent residents is: "When can I apply for citizenship?" The answer depends on how you got your residency, how long you have held it, and how much time you have actually spent in the U.S. This guide explains every rule clearly.

The general rule: 5 years

Most permanent residents qualify to naturalize after 5 continuous years as a resident. Specifically, you must:

• Have at least 5 years since your residency approval date.
• Have continuously lived in the U.S. during those 5 years (no long trips abroad).
• Have been physically present in the U.S. at least 30 months (half) of those 5 years.
• Be a resident of the state where you apply for at least 3 months.
• Have good moral character during those 5 years (especially).

You can file the N-400 up to 90 days before the 5-year mark.

The 3-year rule: married to a citizen

If you are married to a U.S. citizen, you can apply after 3 years as a resident, provided you:

• Are married to the same citizen during those 3 years.
• Your spouse has been a citizen during those 3 years (not just naturalized).
• Live together during those 3 years.
• Meet 18 months physical presence (half).
• Meet good moral character.

If you divorce before 3 years, you fall back to the 5-year rule.

Special rules: 1 year or less

Some categories have accelerated rules:

• Active-duty military during certain periods of hostilities can naturalize immediately with no residency time requirement.
• Peacetime military service: can naturalize after 1 year of honorable service.
• Spouses of U.S. citizens deployed abroad for work (federal government, international organizations, etc.) can naturalize without continuous/physical presence requirements.
• VAWA beneficiaries: can naturalize in 3 years even if not married to a citizen. Also read: VAWA.
• Refugees/asylees: time as a resident counts from one year before getting the green card (effectively 4 years instead of 5).

Continuous presence: the long-trip trap

"Continuous presence" means living in the U.S. continuously. Short trips do not break it, but:

• Trips between 6 and 12 months: presumption of broken presence. Can be rebutted with evidence.
• Trips of 12 months or more: fully break continuous presence, except for employees of certain organizations (requires Form N-470 before traveling).

If you break continuous presence: the clock resets. You must wait 4 years and 1 day from your return to reapply (under the 5-year rule) or 2 years and 1 day (under the 3-year rule).

Physical presence: the exact math

Different from "continuous presence", "physical presence" counts the actual days in the U.S.:

• 5-year rule: need 30 months physically present.
• 3-year rule: need 18 months physically present.

Use your passports to add up departures and subtract from the total. If you are close to the edge, wait a few more months before filing.

Good moral character

"Good moral character" is evaluated during the relevant period (5 or 3 years) and sometimes earlier. What affects it:

• Felonies and serious crimes: permanent or temporary bar.
• DUI: especially if multiple.
• Unpaid child support.
• Unfiled or unpaid taxes.
• Illegal voting or false claim to citizenship: serious bar.
• Lies to USCIS or on forms.
• Illegal trafficking (even without arrest).

If you have any record, consult an attorney before applying.

When NOT to file the N-400

Some residents should wait or consult an attorney first:

• If you have undocumented arrests.
• If you have traveled a lot (may break continuous presence).
• If your residency was based on marriage fraud or other fraud USCIS could find.
• If you owe taxes with no payment plan.
• If you did not register for Selective Service when required (men ages 18-26 who were residents in that range).
• If your residency is conditional and you have not removed conditions (must file I-751 first).

Reasons to naturalize soon

Although there is no obligation, there are good reasons to apply when eligible:

• Full protection from deportation (except extreme cases like fraud or terrorism).
• Right to vote.
• U.S. passport.
• Faster petitions for relatives (spouse and children as immediate relatives, no visa wait).
• Federal benefits with no restrictions.
• Education and scholarships that require citizenship.

Reasons to wait (sometimes)

• If you have a long trip planned that would break continuous presence.
• If you have a recent arrest that needs legal analysis.
