Can I Report Labor Fraud as an Immigrant?

In general, undocumented individuals have the same wage and hour rights as any other worker with documentation. For example, it is illegal for an employer to deny you proper compensation because you lack immigration status. Such an employer can face legal consequences, and you may be able to obtain compensation by reporting this offense, in addition to the possibility of recovering the wages owed to you.

Unpaid wage complaints should be filed with the United States Department of Labor or with a state agency that enforces labor laws. These agencies will not ask you to disclose your immigration status, nor will they share the information you provide with immigration agents.
