How to choose an immigration attorney: 7 key questions before hiring

Hiring an immigration attorney is one of the most important decisions you will make for your family. The wrong attorney can ruin a case, waste years, or burn thousands of dollars. The right attorney can be the difference between legal status and deportation. These are the seven questions to ask in the first consultation.

1. Are you actively licensed? Can I verify it?

The first and most important. A real attorney:

• Has an active state bar license.
• Is subject to ethics rules.
• Can be disciplined for malpractice.

Verify it yourself on the state bar's website:

• Florida: floridabar.org/directories/find-mbr.
• For other states, search "[state] state bar attorney search".

If the person appears "not authorized to practice" or does not appear at all, they are not an attorney. Their office signage does not matter. Read: attorney vs notario.

2. Are you a member of AILA?

AILA (American Immigration Lawyers Association) is the professional association of immigration attorneys in the U.S. Membership is voluntary but a strong signal:

• Ongoing access to law and policy updates.
• Specialized professional training.
• Network of colleagues for complex cases.
• Commitment to immigration as a specialty, not a side service.

Not every good attorney is a member, but if someone claims to be an immigration expert and is not a member, ask why.

3. What is your experience with cases like mine?

Immigration has very different areas:

• Family (marriage, parents, children).
• Asylum.
• Deportation defense.
• Employment (H-1B, EB-1, EB-5).
• Naturalization.
• Humanitarian visas (U, T, VAWA).

An attorney can be excellent in one and new in another. Ask specifically:

• How many cases like mine have you handled?
• What percentage of your practice is this case type?
• Have you handled similar cases with complications like mine (criminal history, irregular entry, prior petitions)?

Honest answers are more valuable than vague promises.

4. How do you charge and what is included?

Two most common arrangements:

• Flat fee: single amount for a defined service (e.g., a full I-130/I-485 package).
• Hourly: monthly invoices based on time worked.

For most immigration cases, flat fees are preferable because they give certainty to the client.

Ask specifically:

• What steps does this fee include?
• What steps does it NOT include (e.g., appeal if denied, complex RFEs)?
• Are USCIS and translation costs separate?
• Do you accept a payment plan?

Get everything in writing in the representation contract. A serious firm never charges cash-only without receipts.

5. Who will handle my case day to day?

In firms with several staff, the attorney who signs the contract is not always the one doing the work. That is normal — but you should know:

• Who is the main responsible attorney on my case?
• Who prepares the forms?
• Who will help me when I call with questions?
• If the lead attorney is on vacation, who covers?

There is no single right answer — some firms work as a team, others are solo attorneys. The important thing is transparency.

6. How do you communicate and how often?

Communication is the most common complaint from dissatisfied clients. Ask:

• What is the preferred channel (email, phone, online portal, messaging)?
• What is the typical response time?
• Will I get proactive updates or do I need to ask?
• Do you serve in Spanish?

If the firm has a client portal where you can see case status, documents, and messages, that is a good sign. Firms with modern systems are usually better organized.

7. What happens if things go wrong?

This question separates a real attorney from one selling promises. Ask:

• What is the worst that could happen in my case?
• If USCIS denies, what options do I have? Appeal, refile, another path?
• If complications arise (unknown criminal history, fraud discovered, etc.), what do you do?
• Do you guarantee results?

No serious attorney guarantees a result. The decision is USCIS's or the judge's, not the attorney's. What a good attorney guarantees is professional and honest work.

If someone promises a result, that is a red flag.

Additional signs of a serious attorney

• Explains case risks, not just benefits.
• Tells you "no" when a path does not apply.
• Charges a reasonable initial consultation — attorney time has value.
• Has a verifiable physical office.
• Provides a written representation contract.
• Accepts traceable payment (check, card, ACH).
• Gives you copies of everything filed with USCIS.

Red flags

• "Guarantees" residency, asylum, citizenship, or any outcome.
• Cash-only with no invoices.
• Has "special contacts" at USCIS or court.
• Pressures you to sign the same day.
• Does not give copies of your case.
• Does not appear in the state bar directory.
• Office is a "services center" with unclear professional ID.

Before your consultation

To get the most out of the first consultation, prepare:

• Written summary of your immigration history.
• Documents: passports, prior petitions, court orders, USCIS decisions.
• List of specific questions.
• Time and money: a serious consultation runs 45-60 minutes.
