Attorney vs. notario in U.S. immigration: the difference

If you grew up in Latin America, the word "notario" means one thing: a highly qualified professional, with a law degree, acting with public authority. In the United States, a notary public is none of that. This cultural confusion has cost thousands of Hispanic immigrants their green card, their money, and even their freedom. What a notary public is in the U.S.

In the United States, a notary public is a person authorized by the state to witness signatures and verify identities. The role is administrative, not legal. A notary cannot:

Give immigration advice.
Fill out USCIS forms for you.
Represent you before USCIS or a judge.
Tell you whether you qualify for residency, asylum, citizenship, or any other benefit.

The notary license is granted after a short course and an easy exam. In most states, no legal education is required.

What an immigration attorney is

An immigration attorney is a professional who:

Has a 4-year college degree.
Has a Juris Doctor (J.D., 3 more years of law school).
Passed a state bar exam.
Is in good standing with a state bar, subject to ethics rules and discipline.

Only a licensed attorney — or a DOJ-accredited representative through the Office of Legal Access Programs (OLAP) — can formally represent you in an immigration matter.

Why fraudulent notarios are a serious problem

Many storefronts in Hispanic neighborhoods post signs that say "Notario" or "Notario Público" and offer to fill out immigration forms. This is the Unauthorized Practice of Law (UPL), illegal in Florida and almost every state.

Common damage we see in our firm:

Cases ruined by poorly filled forms. A mistake in a "background" section can trigger removal.
Unintentional waiver of rights. Some notarios make people sign documents waiving benefits without understanding them.
Money lost. Thousands of dollars charged for packages USCIS rejects.
Lost asylum eligibility by filing after the one-year deadline.
Abandoned cases when the notario disappears or shuts down.

Worst of all, when the case reaches a real attorney, the damage is often already done and sometimes cannot be reversed.

Red flags of a fraudulent notario

If you see any of these signs, walk out:

The business advertises as "notario", "immigration consultant", or "form preparer" without mentioning they are attorneys.
They "guarantee" a green card or any benefit.
They charge cash and do not give itemized receipts.
They do not provide a written contract.
They pressure you to sign quickly without explaining.
They offer "shortcuts" or "contacts" at USCIS or court.
They have no visible law license.

How to verify someone is really an attorney

In Florida, you can check online whether a person is an active attorney through The Florida Bar: floridabar.org/directories/find-mbr. Search by name. If the person does not appear or shows "not authorized to practice law", they are not an attorney.

You can also confirm whether someone is a DOJ-accredited representative in the Recognition & Accreditation Roster from EOIR.

If you were already a notario victim

If you paid a notario and suspect the work was poor or fraudulent, you can:

Request full copies of everything filed with USCIS.
Consult an attorney to assess damage and correction options.
Report the notario to:
- Florida Attorney General — Consumer Fraud Division.
- The Florida Bar UPL Department.
- USCIS Fraud Detection and National Security (FDNS).
If you paid by credit card, request a chargeback within the bank's window.
