What documents to bring to an immigration consultation

An immigration consultation is valuable, but the value depends on how much information you bring. Without documents, the attorney can only give general answers. With the right documents, the attorney can evaluate options, identify risks, and design a strategy from day one. This guide tells you exactly what to bring.

The general rule

Bring copies of everything related to your immigration history, family, and background. If you have originals, bring them so the attorney can review but don't hand them over. If you only have photos on your phone, that's fine — but upload everything to a Google Drive or folder for quick access.

1. Personal identification

For you and each family member included in the case:

Passport (all pages, current and expired).
Birth certificate (with certified translation if in another language).
ID from your home country.
Any U.S. ID you have (driver's license, state ID).

2. Immigration history

Any visa you have held (B-1/B-2, F-1, H-1B, L-1, K-1, etc.).
I-94 (entry/exit record) — downloadable from i94.cbp.dhs.gov.
Green card if you have one.
Current and prior EADs (work permits).
Letters or decisions from USCIS on any prior case (receipts, biometrics, approvals, denials, RFEs).
Letters or decisions from immigration court if you were in proceedings.
Any form you have filed (I-130, I-485, I-589, N-400, I-765, I-131, etc.).

3. How you entered the U.S.

Even if uncomfortable, your attorney needs to know:

Exact or approximate date of your last entry.
How you entered (visa, parole, without inspection, etc.).
If you entered without documents, where.
If you entered on a visa, bring it.
Each time you have departed and re-entered.

This information determines your legal options. Lying or hiding it leads to wrong strategies.

4. Family history

For family-based cases:

Marriage certificate (current and prior).
Divorce decrees (all).
Birth certificates for each child.
If married or planning to marry: spouse's passport / green card / naturalization certificate.
If you have citizen or resident parents or children: their documents.

5. Criminal history — be complete

Even if it's uncomfortable, bring everything:

Any arrest, even if not convicted.
Any charge, even dismissed or sealed.
Any conviction, including minor infractions (DUI, possession, theft, violence).
Final disposition of each case.
Court documents (motion to dismiss, plea agreement, sentencing order).

USCIS and immigration judges can see nearly everything that happened. Your attorney needs to know to protect you.

If you don't have the documents:

Request them from the state court. Usually inexpensive and quick.
Request a background check — FBI or state.
Bring what you remember while you get the official records.

6. Employment and finances

For income-declaration cases (I-864, adjustment of status, EAD by need):

Employment letters or pay stubs.
Tax returns for the last 3 years (with W-2 / 1099).
Recent bank statements.
Business: incorporation, EIN, contracts.

7. If you were a crime victim (U Visa, T Visa, VAWA)

Police reports.
Protection orders.
Photos of injuries.
Threatening messages (screenshots).
Medical records.
Psychologist letters or evaluations.
Witness letters.

8. If you are seeking asylum

Evidence of persecution (reports, photos, threats, complaints in your country).
Documents showing your identity or affiliations.
Information on country conditions (articles, reports).
Details of key dates and events.

9. If you have a case in court (in removal/deportation)

NTA (Notice to Appear) — the document that started your case.
All court notices.
Prior decisions by the judge.
Bond documents if you had a hearing.
Prior attorney's documentation if you had one.

10. Mental checklist of questions

Bring written questions. Some common ones:

What are my options?
How long does each take?
How much does it cost?
What is the risk?
What do you need from me and by when?
Who will handle my case day to day?

How to organize everything

Before the consultation:

Create digital or physical folders by category:
- Identification.
