Are asylum applicants eligible for a labor petition?
The answer is, it depends.
It depends on the amount of time that the person has remained unlawfully in the United States.
So if someone has accumulated more than 180 days of unlawful status, then that person may not be able to be a beneficiary of a labor petition.
However, if the person has accumulated less than 180 days of unlawful status, then there might be a possibility upon the approval of a labor certification and a labor petition, that the applicant could be able to obtain an immigrant visa and therefore a green card.
Now, it’s important to know that the person, more likely than not, needs to do consular processing.
