We receive lots of questions about the following topic, and that is if someone who is currently in an asylum process and also has TPS, if that person is eligible to adjust status here in the United States. The answer is, it depends.

If the person is not in removal proceedings and the person reenter the country with a TPS, then if that person has an approved I-140 or labor petition, then that person could technically adjust status here in the United States.
