I have a deportation order. What are my legal options?

A final order of deportation can be one of the most difficult pieces of news for an immigrant in the United States. However, it is important for you to know that, depending on your case, there may be legal options available.

In many cases, after a judge issues a deportation order, you may:

  • File an appeal within 30 days

  • Request that the decision be reconsidered within 30 days

  • Ask for the case to be reopened within 90 days if there is new evidence or if you now qualify for an immigration benefit

Even after those deadlines, there may be special motions to reopen available in certain circumstances. In some cases, a waiver of deportation may also be explored if you qualify through a family-based or employment-based petition.
