Why do I have to re-enter the U.S. to obtain residency if I entered legally?
Even if you entered legally on a visa, as a tourist or student, you may have lost your status when your I-94 expired. Even if you apply for asylum, that does not ensure continued legal status. If you seek to obtain permanent residence, you will generally need a lawful re-entry into the country. This is a necessary step to apply for residency within the U.S. Although there are exceptions, such as winning an asylum case or marrying a U.S. citizen.
