What’s going on with asylum cases at USCIS? #immigration #jesusreyeslaw

Are you waiting for your asylum interview? Your case could be sent to Immigration Court without that initial interview. Since July 28, 2026, a rule allows USCIS to refer certain affirmative asylum applications directly to Immigration Court without first interviewing the applicant. This change may affect new applications and cases pending with USCIS for which an initial interview has not yet been scheduled. It does not change the procedures for cases already before Immigration Court. However, this does NOT mean that all applications will automatically be sent to a judge. USCIS must review the case file to determine whether a referral without an interview is appropriate. The rule covers certain cases involving people who do not maintain a lawful basis to remain in the United States; those who do will continue to have the opportunity for an interview. Having your case sent to Immigration Court does not, by itself, mean that you have a deportation order. It means that you will need to continue your case before an immigration judge. That is why you should prepare your application carefully from the start: a detailed and truthful statement, evidence supporting what happened, and a clear explanation of the grounds for your request. Do not assume that you will be able to clarify everything during an interview. If you have already submitted your application, seek legal guidance to review your case file and determine whether you need to provide additional information or evidence.
