A recent decision by the Board of Immigration Appeals in Matter of A-K-R could have an important impact on individuals with cases before Immigration Court. Under this decision, an immigration judge may not necessarily be required to grant additional time for a person to obtain legal representation if they have already appeared at their hearings without an attorney. For this reason, it is important to prepare in advance and, whenever possible, attend your hearing with legal representation, whether through a nonprofit organization or a private attorney. The decision includes an exception related to hearings scheduled within the first 10 days after the issuance of the NTA (Notice to Appear).
