Good news for some asylum applicants. Federal Judge Nathaniel M. Gorton halted certain consequences that the government had been imposing on individuals who were unable to pay the annual asylum fee. This may be especially important for those who experienced problems with the payment system or were unable to complete the payment within the required deadline. However, this decision does NOT eliminate the annual asylum fee, nor does it mean that you should stop paying it. It is important to know where to make the payment depending on the type of asylum case you have: • If you have an affirmative asylum case pending with USCIS, the applicable payment must be made through USCIS. • If you have a defensive asylum case before the Immigration Court, the payment must be made through the EOIR payment system. If the system does not allow you to make the payment, keep evidence of your attempts, including screenshots, receipts, and any other documentation that may show that you tried to pay on time.
