DHS blames attorneys for immigration chaos.

On September 15, the Department of Homeland Security (DHS) sent a statement to immigration lawyers accusing us of creating and perpetuating the constant exploitation of the asylum system. And on this point, I want to be clear and fair. If a person has a credible fear of returning to their country due to political reasons, race, religion, nationality, or membership in a recognized social group, and their application is legitimate, that person deserves to seek asylum under the laws currently in place in the United States. And those laws are not changed by a president; they were passed by Congress. There are indeed fraudulent cases that should not be approved, and those who file them—whether attorneys or applicants—should face consequences, because they undermine the integrity of the system. But the existence of a few “bad apples” does not mean that the rest of the people do not have legitimate cases. What concerns me is that they wash their hands of the matter and blame the massive backlog of cases on those of us who legally represent our clients, rather than acknowledging that the system needs immigration reform, greater efficiency, and technology. With that, asylum cases could be reviewed fairly and expeditiously, without overburdening the system.
