COULD YOUR ASYLUM APPLICATION BE DENIED BEFORE YOUR FINAL HEARING? A new decision by the Board of Immigration Appeals (BIA) confirms that an immigration judge can deny an asylum application early, without a request from the Government’s attorney. WHAT DOES THIS MEAN? Your application could be denied without a full hearing to present your testimony and evidence if the facts presented do not establish the legal requirements. WHO DOES IT AFFECT? • Applicants before the Immigration Court • Those seeking withholding of removal WHAT IT DOES NOT DO: It does not order the cancellation of asylum already granted or the denial of all applications pending with USCIS. BUT THERE ARE LIMITS. A judge cannot simply deny any case: • There must be a reasonable opportunity to present the grounds for the claim and supporting evidence. • If important facts are disputed, a full hearing may be warranted. • Each case requires an individual evaluation. DO NOT WAIT UNTIL YOUR FINAL HEARING. Review your application with your attorney to ensure it clearly explains what happened to you, why you fear returning, how those facts support the protection you are seeking, and what evidence supports your case. Submit your documents within the court’s deadlines. This decision does not mean that all applications will be denied. Understanding the requirements and preparing your case on time is essential.
