The new rule states that Immigration can now transfer a case directly to Court, without giving the applicant the opportunity to have an Asylum interview. That is the most significant change, and it takes effect starting today, July 28. Who does it affect? People with a pending affirmative Asylum case before USCIS, meaning a case filed with the agency. It does not affect cases that are already in Court. If you have a case waiting for an interview, or you are thinking about applying for Asylum, this rule could affect you. This does not mean every case will go directly to Court without an interview. What it does mean is that Immigration will use its full discretion to decide. That is why the lesson is clear: when you file a case, do it right from the start, with all the evidence, the arguments, and a detailed declaration.
