The landscape has changed. To understand it, one thing must be clear. Anyone who is not a citizen, a legal resident, or who does not hold a defined legal status can become a target for an arrest by immigration agents. When I talk about a defined status, I mean, for example, a valid TPS or a valid visa (tourist, work, or student). The key point is this: When a person's authorized period of stay expires, even if they have a pending asylum application, in the eyes of the law they no longer hold that defined status. An asylum application gives you a form of protection, but that is not the same as a status. Historically, those who applied for asylum kept a protection while their case moved forward; under current immigration policies, that no longer happens automatically. So, what is the point of applying for asylum? A great deal. If the case is approved, it can open the door to permanent residency. And while the process moves forward, the application can bring important benefits, such as a work permit and a Social Security number. And here is something reassuring: if a person is detained even while their asylum is pending, in many cases it is very likely they can be released on bond and continue their process in freedom, before an immigration judge. This usually applies to those who have good moral character, filed their asylum case, and generally entered the country legally.
