This Wednesday, January 28, 2026, decision by the Ninth Circuit Court of Appeals has brought new hope to the Venezuelan community in the United States. The court determined that the Department of Homeland Security does not have the authority to arbitrarily terminate Temporary Protected Status (TPS) for Venezuela. This ruling underscores that TPS is a benefit derived from laws passed by Congress and cannot simply be eliminated at the administrative discretion of this department while the program remains in effect.

Although the case will likely ultimately be reviewed by the Supreme Court, this ruling represents a source of hope for beneficiaries. We must wait to see what happens in the coming days. This decision does not have an immediate practical effect.
