Should I apply for a waiver if my spouse is an American?
The answer depends on whether you entered the U.S. legally or illegally. For most cases where you entered illegally and accumulated more than 180 days of unlawful stay, an immigration waiver is necessary.
However, if you were lawfully admitted to the country and are married to a U.S. citizen, the law will exempt you from this requirement and you may apply directly for permanent residency.
