Is all immigration to the United States temporarily suspended?

As it is generally known, the President of the United States recently issued an Executive Order suspending immigration to the United States for 60 days, said Order is effective as of Thursday, April 23 at 11:59 pm.

We may ask ourselves, what is the purpose of this Executive Action?

The fundamental purpose of this measure, according to the US President is to preserve jobs for American workers in the face of an economy deteriorated by the Coronavirus pandemic; however, it is worth noting that pro-immigrant activists consider that this measure is driven by political motives, rather than the desire to mitigate the effects of the Coronavirus on the economy. Without going into details about this controversy, we should ask ourselves:

To whom does the Executive measure really apply?

This Executive Order applies to the following people:
First, those outside the US at the time the measure came into force.
To those who do not have an immigrant Visa on the effective date of the measure.
To those who do not have a valid official travel document (such as a transport letter, boarding pass or advance travel permit document) on the effective date or issued on any other later date that allows travel to the US to request admission .

Likewise, the Executive Order stops some Work Visas and imposes new requirements for certain Visas such as the H-1B type for foreign professionals, who must provide updated certifications to the Government that are not displacing US Workers, this includes exceptions for the Type H Visa. -2 of agricultural workers.

Now, who is exempted from this temporary measure of suspension of immigration to the United States?

First, the Permanent Legal Residents.

Secondly, doctors, nurses and other health professionals seeking to enter the country with an Immigrant Visa.

Third, foreigners who apply for an Immigrant Visa through the EB-5 Immigrant Investor Program.

Fourth, spouses of US citizens and children under 21.

Fifth, members of the US Armed Forces and their spouses and children.

On the other hand, it should be noted that the measures taken by the National Executive require that the measures be reviewed within 30 days of the effective date of the Executive Order.

Finally, I want to inform you, for the peace of mind of many of my readers, that all immigration cases being processed within the U.S. will not be affected by this Executive action for now, this means that if you are going to adjust your status in the U.S. or apply for a U or T Visa or a Waiver, or are waiting for a Work Permit renewal, you will not be harmed, neither will the Asylum, nor the Temporary Work Visa, among others, will only be harmed the cases that are going to have an appointment in an American Consulate, obviously abroad, in the following 60 days.The the number of people that will be impacted by this measure will be minimal.
