Possible Automatic Denial for Some Asylum Cases

According to a recent report by CBS News, the government may be preparing a memorandum that would instruct officers to automatically refer asylum applications filed after the first year of entry into the United States to immigration court. Under this measure, those individuals would not receive an asylum interview with an officer.

This measure is not official policy at this time. It is still pending confirmation.

Who could be protected from this measure?
• Minors who entered through the border and applied for asylum.
• Unaccompanied minors without legal guardians.
• Individuals who maintained lawful status during the first year after entering the United States.

Important: Even if your case is referred to immigration court, you may still qualify for asylum if you can demonstrate a valid reason for filing late, or if conditions in your home country have significantly worsened since your arrival.
