What Is the Political Asylum Process Like?

There are two paths to apply:

Affirmative Asylum: For those who are in the U.S. and not in removal proceedings. It is filed with U.S. Citizenship and Immigration Services.

Defensive Asylum: If you are in removal proceedings, you must apply before an immigration judge.

Possible Decisions:

Approved: You will be granted asylum, allowing you to live and work in the U.S. You may apply for lawful permanent residence after one year.

Denied: You may appeal the decision to an immigration judge.
