Traffic Violation May Affect Your Road to Residency or Naturalization

As it is well known, there are four necessary requirements that allow an undocumented immigrant to request that his deportation process be canceled. Those requirements are as follows:

– That the immigrant reside in the country for more than 10 years

– That he is married to a resident or American citizen.

– Have children over 21 years old

– Have good moral character

Once these requirements have been met, the immigrant must fill out form 42B to ask a judge to cancel his order of expulsion from the US and to be granted Permanent Residence.

However, it is important to note that as a result of a ruling issued last Friday by the Immigration Case Review Office (EOIR), there has been a tightening of one of the requirements mentioned above. That requirement is to “have good moral character.” In this regard, the Office (EOIR) established that a foreigner lacks good moral character under the Immigration and Nationality law if he has received two or more convictions for driving under the influence of alcohol or other drugs (DUI). This unfortunately would result in the immigrant losing the opportunity for his deportation order to be canceled and losing the privilege of staying in the US.

Personally, it is important to inform the immigrant community to avoid the consequences of drinking and driving; since if they are arrested for drunkenness they will have legal, financial and personal consequences etc.
