We receive a lot of questions about the following topic: if someone who is currently in an asylum process and also has TPS is eligible to adjust status here in the United States. The answer is, it depends.

If the person is not in removal proceedings and re-enters the country under TPS, then if that person, the applicant, has an approved I-140 or employment-based petition, that person could technically adjust status here in the United States.
