EB-5 investor visa: requirements and process in 2026

The EB-5 is the visa category for foreign investors who meet certain investment and job-creation requirements. It leads to permanent residency for the investor, spouse, and unmarried children under 21. It is a serious option, but also complex and with real financial risk. This guide explains the 2026 picture.

EB-5 basics

The EB-5 program was created by Congress in 1990 to attract foreign capital and create jobs. In 2022, Congress reauthorized and modernized it with the EB-5 Reform and Integrity Act, in effect in 2026.

Main requirements:

• Investment in a new U.S. commercial enterprise.
• Investment must come from lawful funds of the investor.
• Must create or preserve at least 10 full-time jobs for U.S. workers.
• The investor must be involved in the business (management or policy).

How much to invest in 2026

There are two levels by project location:

• $800,000 if the business is in a Targeted Employment Area (TEA):

  • Rural area, or
  • High-unemployment area (at least 150% of national average), or
  • Specific infrastructure area.

• $1,050,000 if the business is outside a TEA.

The difference is $250,000, so most EB-5 projects seek TEA qualification.

Two paths: direct vs Regional Center

Direct EB-5

The investor creates or invests in a business they manage themselves. Must show direct creation of 10 full-time (W-2) jobs. More control, more operational responsibility.

Regional Center EB-5

USCIS designates Regional Centers as entities that pool EB-5 investments into larger projects (hotels, buildings, infrastructure). The investor:

• Buys a share in a pre-approved project.
• Does not manage the business directly.
• Can count indirect and induced jobs (not just W-2).

This is the most common route. But it requires strong due diligence: not all Regional Centers are solid, and there have been notorious frauds. Verify before investing.

The most critical piece: lawful source of funds

USCIS requires detailed source of funds documentation — where every dollar came from. This includes:

• Investor's multi-year financial statements.
• Tax returns (local and foreign).
• Documents from property sales, inheritances, gifts.
• Bank statements showing the money trail.
• Documentation of salaries, dividends, business sales.
• If from cards or loans: loan and collateral documents.

The path of funds — how the money reached the project — must also be documented step by step. Countries with capital controls add significant complexity.

The step-by-step process

1. Project selection (direct or via Regional Center).
2. Legal structuring and signing investment documents (escrow recommended).
3. Investment deposit in escrow or directly.
4. Filing I-526E (Investor Petition). Time: 24 to 48 months in 2026.
5. If outside the U.S.: consular interview and entry on EB-5 visa.
6. If inside the U.S. with eligible status: adjustment of status (I-485).
7. 2-year conditional residency.
8. I-829 — removal of conditions — in the 90 days before the 2-year mark. Shows the investment was sustained and jobs created.
9. Unconditional permanent residency.

Realistic timelines

• I-526E: 24-48 months (set-asides for rural and high-unemployment can be faster).
• Adjustment or consular: 12-24 months by country and route.
• I-829: 24-36 months.

Realistic total: 4-8 years from investment to unconditional green card.

Set-asides — annual reserves

The 2022 reform created set-asides to speed certain cases:

• 20% for rural investments.
• 10% for high-unemployment areas.
• 2% for infrastructure.

Set-asides can meaningfully reduce processing times.

Risks to consider

EB-5 is a real investment, not a paperwork process. Risks include:

• The project may fail — losing capital and eligibility.
• USCIS may deny the I-526E or I-829 if documentation is insufficient.
• Changes in law or USCIS policy can affect the process.
• Some Regional Centers have been fraudulent.
• The "exit" (recovering money after requirements met) is not guaranteed.

For these reasons, EB-5 requires dual counsel: an immigration attorney for the immigration case and financial/legal counsel to evaluate the project.

Who is EB-5 for?

It is for people who:

• Have liquid capital of $800K-$1M+ beyond process and living expenses.
• Can fully document the source of funds.
• Accept long timelines and investment risk.
• Do not have a faster family route available.
• Aim at permanent residency as the main goal.
