Changes to work permits based on Asylum

The U.S. Citizenship and Immigration Services (USCIS) announces a Rule, among other provisions, stating that an alien who enters the U.S. illegally without a good cause will not be granted Employment Authorization.

The Central Government of the United States has implemented, as of Tuesday August 25th, a rule that denies work permits to asylum seekers who cross its borders without authorization, making it more difficult for these immigrants to survive as long as their cases are heard or processed by an Immigration Judge.

Likewise, the norm contemplates new provisions of prohibitions and denials among which the following stand out:

• Asylum applicants with certain criminal behavior will not be allowed Employment Authorization.
• Extends the time that an Asylum applicant can apply for a Work Permit, which previously was 150 days to 365 calendar days.
• The period of validity of the Employment Authorization is limited to a maximum of 2 years and will automatically terminate the Authorization when an applicant’s denial of Asylum is administratively final.
• If the person or immigrant causes a hindrance to his or her own asylum, such as a delay because he or she was not able to attend the immigration office on time to have his or her fingerprints taken, or was not able to arrive on time for the interview, he or she will be denied a Work Permit.
• Immigration officers will have full discretion to deny a Work Authorization.

It is important to take into account that as of August 25th a new form will be used to apply for the Work Permit, it must be properly filled out without leaving any blank spaces, according to the new rules issued by the Immigration Agency on how to fill out these forms, also the address indicated must be the correct one and the fees that will be paid to immigration are to be exact nothing more or less, to avoid your application from being denied.
