Can a person leave the United States while in an asylum process? The answer is yes! However, keep these 4 points in mind…
- You cannot be in removal proceedings
- You cannot use it to travel to your home country or the country where you hold citizenship
- You should not have a pending criminal or civil case against you, or an unfavorable criminal record
- It is advisable to use it only for emergency situations
Unlike TPS travel authorization (parole), which allows you to:
- Travel outside the United States, including to your home country (as long as you are not seeking asylum)
- You do not need to justify your request for TPS travel authorization with an emergency
- If you have a criminal history or pending legal proceedings against you, it is recommended that you seek legal counsel before using the TPS travel permit
