Advance Parole is permission, granted in advance, to leave the U.S. and re-enter without abandoning your pending immigration case. For many people with I-485, TPS, pending asylum, or DACA, it is the only way to travel legally. It is also one of the most case-destroying filings when people leave before approval. Here is how to use it correctly.
Advance Parole is DHS authorization to re-enter the U.S. after international travel without the trip counting as abandonment of your pending application or triggering the 3/10-year bars. You apply with Form I-131 (Application for Travel Document).
It is not a visa or a status. It is a re-entry permission, subject to CBP inspection at the port of entry. CBP can still deny entry if it finds new inadmissibility grounds.
Most common categories:
If you hold a valid, maintained nonimmigrant visa (H-1B, L-1, F-1 with current visa), you usually do not need AP — you travel on your visa.
Ideally, file I-131 with the I-485 up front. USCIS issues the AP as a combo card with the EAD (c09) in roughly 3 to 8 months.
If you already filed I-485 without I-131, you can add it later. The key rule: do not leave until the AP card is in your hand.
For urgent travel (medical emergency, funeral), you can ask for emergency AP at a USCIS field office with an appointment. Valid cases take 1-3 weeks.
If you leave the U.S. before AP is approved:
This happens often because people receive the I-797C receipt for the I-131 and think they have permission. The receipt is NOT the permission. Only the combo card (or paper I-512) authorizes travel.
