{"id":57680,"date":"2026-05-11T14:20:16","date_gmt":"2026-05-11T18:20:16","guid":{"rendered":"https:\/\/jesusreyeslaw.com\/?p=57680"},"modified":"2026-05-11T14:20:16","modified_gmt":"2026-05-11T18:20:16","slug":"proposed-fee-increase-for-applying-to-cancellation-of-removal","status":"publish","type":"post","link":"https:\/\/jesusreyeslaw.com\/en\/proposed-fee-increase-for-applying-to-cancellation-of-removal\/","title":{"rendered":"Proposed Fee Increase for Applying to Cancellation of Removal"},"content":{"rendered":"<p class=\"p1\">If you have a deportation order and you&#8217;re considering applying to have it suspended, there&#8217;s something important you need to know right now.<\/p>\n<p class=\"p1\">The federal government has just published a proposal that could dramatically increase the cost of that application.<\/p>\n<p class=\"p1\"><b>What is Cancellation of Removal?<\/b><b><\/b><\/p>\n<p class=\"p1\">It&#8217;s the official application that allows a person with a deportation or removal order to ask the government to suspend \u2014 or temporarily stop \u2014 that removal.<\/p>\n<p class=\"p1\">It is not a permanent solution. But it can provide valuable time while other legal options are explored.<\/p>\n<p class=\"p1\"><b>The Proposed Increase<\/b><b><\/b><\/p>\n<p class=\"p1\">Currently, filing Form I-246 costs $155.<\/p>\n<p class=\"p1\">That fee was set in 1989 and has not changed in more than 37 years.<\/p>\n<p class=\"p1\">Now, the Department of Homeland Security \u2014 through ICE \u2014 is proposing to raise that fee to $755.<\/p>\n<p class=\"p1\">That is an increase of $600, nearly four times the current cost.<\/p>\n<p class=\"p1\">Official announcement:<\/p>\n<p class=\"p1\"><a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/05\/07\/2026-09007\/fee-adjustment-for-us-immigration-and-customs-enforcement-form-i-246-application-for-a-stay-of\">https:\/\/www.federalregister.gov\/documents\/2026\/05\/07\/2026-09007\/fee-adjustment-for-us-immigration-and-customs-enforcement-form-i-246-application-for-a-stay-of<\/a><\/p>\n<p class=\"p1\"><b>Why The Increase?<\/b><b><\/b><\/p>\n<p class=\"p1\">The government justifies this change by saying the current fee does not cover the actual costs of the process \u2014 including labor, technology, and administrative expenses.<\/p>\n<p class=\"p1\">It also cites an executive order directing that immigration benefit applicants, not taxpayers, should bear those costs.<\/p>\n<p class=\"p1\"><b>Who is affected?<\/b><b><\/b><\/p>\n<p class=\"p1\">This increase directly affects people who have a deportation or removal order and need time to resolve their immigration situation.<\/p>\n<p class=\"p1\">For many families, going from $155 to $755 is not a simple adjustment. It can represent a real barrier to accessing this legal tool.<\/p>\n<p class=\"p1\"><b>Fee Waiver?<\/b><b><\/b><\/p>\n<p class=\"p1\">There is an important note: the proposal keeps the option to request a fee waiver for those who cannot afford the cost.<\/p>\n<p class=\"p1\">To do so, you will need to submit a detailed statement describing your financial situation, under penalty of perjury.<\/p>\n<p class=\"p1\">If you find yourself in this situation, consult with an attorney before submitting any such declaration.<\/p>\n<p class=\"p1\"><b>Comment Period<\/b><b><\/b><\/p>\n<p class=\"p1\">This proposal is NOT yet final.
